1. Acceptance of Terms

By accessing or using this website operated by TheCardShark Collectables, you agree to be bound by these Terms & Conditions. If you do not accept these terms, you must not use this website or place an order.

 

2. Products, Authenticity & Descriptions

All trading cards and collectables offered by TheCardShark Collectables are sourced directly by us. To the best of our knowledge, all products sold are genuine and authentic. Product descriptions, images, and details are provided in good faith. Any grading, authentication, or certification information will be clearly stated where applicable.

 

3. Product Condition

Unless explicitly stated, ungraded or raw cards may display minor imperfections, including but not limited to edge wear, surface marks, centring variations, or print lines resulting from the manufacturing and packaging process. TheCardShark Collectables does not warrant that ungraded cards are flawless or in mint condition.

 

4. Pricing & Payment

All prices are displayed in Australian Dollars (AUD) and include GST where applicable. TheCardShark Collectables reserves the right to amend prices, product information, or correct errors at any time without prior notice.

 

5. Orders & Acceptance

All orders are subject to availability and confirmation by TheCardShark Collectables. We reserve the right to refuse or cancel any order due to stock discrepancies, pricing errors, or suspected fraudulent activity. In such cases, a full refund will be issued.

 

6. Shipping & Delivery

TheCardShark Collectables aims to dispatch all orders within 1–3 business days of order confirmation. Dispatch time frames are estimates only and are not guaranteed, as unforeseen circumstances such as processing delays, carrier disruptions, or natural events may occur.

All items are packaged securely. Risk and responsibility for goods pass to the customer once the order has been dispatched. TheCardShark Collectables is not liable for delays, loss, or damage caused by third-party carriers.

 

7. Force Majeure

TheCardShark Collectables will not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, postal or carrier disruptions, supplier delays, or government actions.

 

8. Returns & Refunds

Returns are accepted within 7 days of delivery, subject to the following conditions:

• Items must be returned in their original condition.
• Sealed products must remain unopened.
• Return shipping costs are the responsibility of the customer unless the item is faulty or incorrect under Australian Consumer Law.

Refunds will be processed upon receipt and inspection of the returned item.

 

9. Opened Products

Due to the nature of trading cards and collectables, opened packs, boxes, or products are not eligible for return or refund, except as required under Australian Consumer Law.

 

10. Australian Consumer Law

Nothing in these Terms & Conditions is intended to exclude, restrict, or modify the guarantees provided under Australian Consumer Law. Customers are entitled to remedies for major failures and other losses as prescribed by law.

 

11. Limitation of Liability

To the maximum extent permitted by law, TheCardShark Collectables will not be liable for any indirect, incidental, or consequential loss arising from the use of this website or purchase of products.

 

12. Intellectual Property

All content on this website, including text, images, branding, and logos, is the property of TheCardShark Collectables and may not be reproduced, distributed, or used without prior written consent.

 

13. Governing Law

These Terms & Conditions are governed by the laws of Australia, and any disputes will be subject to the exclusive jurisdiction of Australian courts.

 

14. Amendments

TheCardShark Collectables reserves the right to update or amend these Terms & Conditions at any time. Continued use of the website constitutes acceptance of the revised terms.

By purchasing, entering, or participating in any Duck Race, you expressly acknowledge that you have read, understood, and agree to be legally bound by the following Terms & Conditions in full. If you do not agree, do not purchase an entry.

 

1. Nature of Event & Entertainment Disclaimer

All Duck Races are conducted solely for entertainment and novelty purposes only. Participation does not guarantee any prize or outcome. Each race has one (1) winner only.

This promotion is not gambling, not a lottery, not a raffle, and not a game of chance for profit, and is conducted purely as an entertainment-based promotional activity.

 

2. Eligibility & Legal Compliance

Participants must be legally permitted to make purchases using their chosen payment method.

By entering, participants confirm that:

• They are authorised to use the payment method provided.
• They have obtained permission from the cardholder if the payment method does not belong to them.
• They accept full responsibility for the purchase.

Entries made using unauthorised payment methods, stolen cards, or without proper authorisation may be cancelled, voided, and reported, without refund.

Participants are responsible for ensuring compliance with all applicable local, state, national, and international laws.

 

3. Entry Purchase, Allocation & Finality

Each purchased entry represents one (1) randomly allocated duck number.

Duck numbers are assigned entirely at random and cannot be selected, modified, transferred, exchanged, or reassigned.

Once purchased, all entries are final, fixed, and irreversible.

 

4. Strict No Refund, No Cancellation & No Chargeback Policy

Change of Mind – No Refund Policy

Change of mind does not entitle the purchaser to a refund under any circumstances.

By purchasing a Duck Race entry, you acknowledge and agree that all purchases are final, and no refunds, cancellations, or reversals will be issued for change of mind, including but not limited to:

• Purchasing the wrong quantity
• Misunderstanding the product
• Deciding not to participate
• Any personal or financial reasons

You expressly waive any right to claim a refund based on change of mind.

 

Final Sale Policy

ALL SALES ARE FINAL.

No refunds, cancellations, reversals, store credits, substitutions, chargebacks, or payment disputes will be accepted under any circumstances whatsoever, including but not limited to:

• Platform errors
• Payment gateway failures
• Internet or device malfunction
• Livestream interruptions
• Scheduling delays
• Technical faults

By purchasing an entry, you irrevocably waive all rights to dispute, reverse, or charge back any transaction.

 

5. Race Format, Scheduling & Platform Disclaimer

Races are conducted live on Instagram or any other platform used by TheCardShark Collectables once all entries are sold.

Race dates and times are estimates only and may be changed, delayed, rescheduled, or cancelled at any time without notice due to technical issues, connectivity problems, platform outages, staff availability, or operational requirements.

The organiser reserves the absolute right to reschedule, rerun, delay, modify, suspend, cancel, or void any race, at its sole discretion, without refund.

 

6. Winner Determination & Finality of Results

The winner is determined strictly by the order in which the ducks finish the race.

Race results are final, binding, and not subject to appeal, dispute, review, or challenge under any circumstances.

Video footage, livestream recordings, or organiser determinations shall serve as conclusive evidence of the result.

 

7. Prize Terms & Substitution Rights

Only one (1) prize per race will be awarded.

Prizes are non-transferable, non-refundable, non-exchangeable, and not redeemable for cash.

The organiser reserves the right to substitute any prize with another of equal or greater value if required.

 

8. Shipping & Risk Transfer

• Shipping is paid separately by the winner after the race has concluded.
• The winner must pay the shipping fee by visiting the shipping section in the shop and selecting the “Duck Race Shipping” method.
• The standard Duck Race shipping fee is $15 AUD flat rate, covering any size item won in Duck Races only.
• Entries may display “free shipping” solely for administrative or platform purposes — this does not include prize shipping.
• The winner is solely responsible for providing accurate and complete delivery details.
• The organiser is not responsible for courier delays, lost parcels, theft, damage, incorrect delivery, customs issues, or carrier errors.
• All risk transfers fully to the winner once the prize has been dispatched.

 

9. Fraud, Abuse, Manipulation & Disqualification

Any attempt to manipulate, abuse, exploit, or compromise the integrity of the race or purchasing system may result in:

• Immediate cancellation of entries
• Disqualification
• Permanent banning
• Withholding of prizes
• Legal action

All without refund.

 

10. Platform, Technical & Service Disclaimer

The organiser accepts no responsibility or liability for:

• Website failures
• Payment gateway errors
• Instagram outages
• Livestream interruptions
• Internet connectivity problems
• Video quality degradation
• Third-party system faults

Race outcomes remain valid and binding regardless of technical disruptions.

 

11. Full Liability Waiver & Indemnity

To the maximum extent permitted by law, participants release, indemnify, and hold harmless the organiser, its owners, staff, agents, and affiliates from any and all claims, damages, losses, costs, legal fees, liabilities, or causes of action arising directly or indirectly from:

• Participation
• Prize acceptance
• Prize use
• Shipping
• Technical failures
• Platform outages
• Delayed or failed delivery
• Race results

 

12. No Warranties

All races, prizes, and services are provided “as is” without warranties of any kind, express or implied.

 

13. Force Majeure

We shall not be liable for failure or delay caused by events beyond reasonable control, including but not limited to:

• Natural disasters
• Power outages
• Internet failures
• Platform shutdowns
• Government restrictions
• Pandemics
• Industrial action

 

14. Right to Modify, Cancel or Terminate

The organiser reserves the absolute right to modify, suspend, or terminate any race, promotion, or these Terms & Conditions at any time without notice, without liability.

 

15. Entire Agreement

These Terms constitute the entire agreement between participants and the organiser and supersede all prior communications.

 

16. Acceptance of Terms

By purchasing a Duck Race entry, you fully, irrevocably, and unconditionally accept these Terms & Conditions in their entirety.
